EU Second-Life EV Battery Regulations

The short version. The EU Batteries Regulation (Regulation (EU) 2023/1542, in force since August 2023) explicitly permits second-life reuse of EV battery packs for stationary storage. Home users can legally repurpose retired EV packs subject to documentation, notification, and safety obligations. National grid codes (VDE-AR-N 4105 in Germany, G98/G99 in the UK, CEI 0-21 in Italy, UTE C 15-100 in France) govern grid connection of the storage inverter. Household insurance typically requires notification of a lithium storage installation.

EU Batteries Regulation 2023/1542 — main provisions

Regulation (EU) 2023/1542 of the European Parliament and of the Council of 12 July 2023 concerning batteries and waste batteries repealed Directive 2006/66/EC. It is the current legal framework across all EU member states and entered into force on 17 August 2023, with obligations phased in through 2028.

Article 45 — repurposing rules in detail

Article 45 sets out the obligations on the economic operator that repurposes a battery:

For a self-installer using a single pack in their own home, the "economic operator" role may fall on the supplier of the pack, on an installer, or on the homeowner — national implementation varies. Most member states treat single-household non-commercial reuse pragmatically, but documentation (SoH report, safety inspection) is best practice regardless.

Article 77 — Digital Battery Passport (in force 18 February 2027)

From 18 February 2027, industrial batteries and EV batteries with capacity ≥ 2 kWh placed on the EU market must carry a digital battery passport with a machine-readable QR code linking to information on manufacture, chemistry, SoH, safety incidents and end-of-life. This substantially simplifies second-life assessment — a repurposer will be able to read the passport rather than run an independent test regime.

Existing packs placed on the market before that date are not retroactively required to have a passport, but pack-level testing (open-circuit voltage, capacity check, insulation resistance, cell-voltage spread) delivers the same information.

National grid codes for battery storage

Whatever the pack's origin, the storage inverter connects to the grid subject to national grid codes. The installer handles compliance; below are the primary reference documents by country.

Insurance implications

Household insurance typically requires notification when a lithium battery storage system is installed. Common insurer expectations:

National fire codes for domestic lithium storage vary. General principles most jurisdictions apply:

Frequently asked questions

Is second-life EV battery reuse legal in the EU?

Yes. EU Regulation 2023/1542 Article 45 explicitly permits repurposing of used batteries subject to documentation and safety obligations.

Do I need a battery passport for a pack I own personally?

The passport requirement (Article 77, from 18 February 2027) applies to batteries placed on the EU market from that date. It does not retroactively apply to packs manufactured earlier. However, having a comparable documentation set (SoH, chemistry, safety history) is best practice for insurance and inspection.

Can I import a used Tesla pack from the US?

Legally, yes — but shipping (ADR/IMDG dangerous goods), import duties, VAT and CE conformity all apply. Most EU installers source domestically to avoid the paperwork.

Does the EU Batteries Regulation apply to UK installations?

Not directly since Brexit. UK is developing its own equivalent. Practically, most UK installers reference EU test standards. G98/G99 governs the grid connection regardless.

What if my installer is not aware of second-life rules?

The grid-code compliance obligations on the installer are the same as for a new battery — those are the inverter's responsibility, not the pack's. The pack-side documentation is a separate matter and largely the owner's responsibility.

Do I need a certified electrician?

In every EU country, grid-connected installation of a battery storage system requires a nationally certified electrician (SEP/EMR in PL, Meister in DE, MASE in IT, RGE in FR, NICEIC in UK, etc). HV DC packs also require training in HV work.

Are there subsidies for second-life storage?

Rules vary. Some national schemes (KfW 442 in Germany, Mój Prąd in Poland) have historically required new batteries. Some regional schemes (in Italy, Spain, Netherlands) are neutral on used vs new. Verify current rules with the granting authority.

What happens at the end of the second life?
